Payment Plan Terms

This document sets out the terms relation to the Payment Plan. Willows Veterinary Centre and Referral Service is a business unit of Linnaeus Veterinary Limited. By making your first instalment of the plan you confirm that: (i) you are the legal owner of the pet(s) ("Your Pet"); (ii) you wish to enter into a contract for a Payment Plan (“Plan”) Linnaeus Veterinary Limited ("us", "our", "we"); and (iii) you agree to these terms.

Please read these terms carefully. If you have questions concerning them please raise these with us before making your first payment. If you would like a copy of these terms in larger print, please ask at our reception.

  1. Agreement
    • These terms, and the first instalment of the Plan, will form the basis of our contract with you.
    • These terms may be varied on one (1) month’s written notice given to you by us. Such notice may be given by email, letter or by way of an update posted on our website.
    • We reserve the right to refuse any applications for the Plan at our absolute discretion.
  2. Your responsibilities
    • You are responsible for adhering to the terms of the Plan.
      • Fifty per cent (50%) of balance due to commence the Plan; followed by
      • Three (3) monthly instalments to settle the remaining balance.
  1. Payments

Payments

  • Your Plan instalments can either be made:
    • by direct debit monthly; or
    • in full, at Willows Veterinary Centre and Referral Service

Direct Debit

  • Your monthly instalments will be collected by Direct Debit on the date agreed at the start of the of the plan.
  • For the avoidance of doubt, your contract is with us.
  • If you have any queries in relation to the administration of your Direct Debit then please contact enquiries@willows.uk.net or call 0121 712 7070.
  • If you need to change your bank details or any collection dates please contact enquiries@willows.uk.net or call 0121 712 7070 seven (7) working days prior to the due date for collection. You will not be charged for the changes stated in this clause 3.

Non-payment

  • If we are unable to collect your monthly payment we will inform you accordingly and attempt to collect the payment from your account within ten (10) days. Your Plan will be terminated if you default on two successive payments.
  • If you cancel your Direct Debit for any reason at anytime, we will treat our contract with you as terminated.
  • If your Plan is cancelled automatically because of failed direct debits, or if you cancel your Direct Debit for any reason, your account will be reviewed.
  • Any unpaid balances relating to your Plan may be referred to a third party debt collection agency at our absolute discretion.
  1. Ending our agreement / cancelling your Plan
    • We reserve the right to terminate your Plan by giving you one (1) month's written notice, for any reason that we consider reasonable and necessary.
  2. Complaints

Should you ever have cause to complain about the service you receive, please refer to the practice's complaints process which can be found on the website (www.willows.uk.net) or you can ask for a copy from your veterinary team in the practice

  1. How we use your information

Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which is accessible on the following website at https://www.mars.com/privacy-policy-us and explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

  1. General

7.1     All notices given to us under the provisions of these Terms must be in writing and sent to Friars Gate, 1011 Stratford Road, Shirley, West Midlands B90 4BN, UK. When we write to you by post, we will use the address most recently provided.

7.2     For the purposes of the Contracts (Rights of Third Parties) Act 1999 this agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.

7.3     We shall only be liable for any loss or damage suffered by you which is a  reasonably foreseeable consequence of a breach of these Terms. Any treatment received, services rendered, or medicines dispensed to you by us will be handled in accordance with and subject to these Terms (available on request).

7.4     Your Plan is not transferrable.

7.5     These Terms are governed by the laws of England. The courts of England shall have exclusive jurisdiction over any claim or dispute arising under the Terms.

 

 

The Direct Debit Guarantee        

  • This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits.

If there are any changes to the amount, date or frequency of your Direct Debits we will notify you 10 working days in advance of your account being

    • debited or as otherwise agreed. If you request us to collect a payment, confirmation of the amount and date will be given to you at the time of the request.
    • If an error is made in the payment of your Direct Debit, by us or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society – If you receive a refund you are not entitled to, you must pay it back when we ask you to.
    • You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us.
